Storm Drains & Easements

When Est Passage Estates was designed, storm drain easements were created and recoded in the deeds. They permit the Town access to repair or replace storm drains. Many are unaware of the easements and have landscaped these areas. 

 The storm drains in East Passage Estates generally run under the roadways and then along drainage easements and empty into the ponds, with two exceptions. These easements are shown in black on this map. The storm drain between 238 and 243 America Way drains to the north via an easement into conservation land. The drain located in the cul-de-sac at the end of Constellation Court drains north into conservation land via an easement. 
 
 

The question of public access easements or rights-of-way to the ponds comes up from time to time. This was researched and discussed by the Board in 1998. The Board found that there are no public assess right-of-way to the ponds. A letter was sent by the Board to all lot owners pointing out that only the Town can use drainage easements and the only legal way for lot owners, who do not live next to the ponds, to reach them is by the path off Intrepid Lane.
